CASE NUMBER: 18/2016 – TIMILE vs RAINBOW COMMUNITY RADIO – BALANCE

radioThis is a complaint against a broadcast by a Christian Broadcaster for the way in which it conducted its so-called Thanks-Give-A-Thon drive for donations. Broadcaster, being a non profit organisation legally entitled to solicit donations from the public. Broadcaster also has the right to freedom of expression.  The Complainant described the donations drive of the Broadcaster inter alia as unbridled extortion, emotional blackmail and brainwashing of its listeners. The Broadcaster described the complaint as frivolous, vexatious and a figment of the Complainant’s imagination. The only possible contravention on which the Complainant could succeed is that the programme lacked balance in terms of clause 13.  Tribunal finding that the topic of this programme does not comply with the description of a controversial issue of public importance.  In any case, a phone-in type of programme like this one ensures that opposing points of view are broadcast, thus complying with clause 13 of the Code.  No contravention was found and the complaint was not upheld.
